“Delinquency” in New Jersey means the commission of an act committed by a juvenile that would constitute a criminal offense if committed by an adult. Criminal offenses in New Jersey are broken down into crimes and disorderly and petty disorderly persons offenses. Juvenile delinquency can be charged for any of these offenses unless excluded by statute.

Traffic violations are not criminal offenses in New Jersey. Therefore, offenses such as driving without a license and even DWI are not acts of delinquency. However, criminal charges that stem from these incidents can result in a delinquency case.

Many juvenile offenses are alcohol related. A juvenile that provides alcohol to another juvenile can be prosecuted for delinquency. Underage consumption of alcohol often leads to other acts of delinquency as well.

Juveniles in Middlesex County are also commonly accused of drug possession. Charges for marijuana possession, prescription pill and even heroin are regularly made in Middlesex County.

Other frequent juvenile offenses in Middlesex County are:

  • Assault
  • Burglary
  • CDS possession
  • Drug possession
  • Eluding
  • Harassment
  • Marijuana Possession
  • Obstructing the Administration of Law
  • Sex Offenses
  • Shoplifting
  • Theft
  • Trespassing

Juveniles accused of criminal offenses do not have the same rights as adults. For example, juveniles in New Jersey do not have the right to a jury. New Jersey juvenile delinquents do not have the right to a Grand Jury presentment of their case. However, there are rights that a juvenile does have in court. These include the right to an attorney and the right to remain silent.

I defend juveniles from towns including: Avenel, Carteret, Cranbury, Dunellen, Edison, Helmetta, Highland Park, Jamesburg, Metuchen, Middlesex, Milltown, Monroe, New Brunswick, North Brunswick, Old Bridge, Perth Amboy Piscataway, Plainsboro, Sayreville, South Amboy, South Brunswick, South Plainfield South River, Spotswood, and Woodbridge.

Juveniles are prosecuted in New Jersey in the county they reside. So if your family lives in any of the above towns, your child’s case will be heard in the Middlesex County Superior Court. Where the offense takes place is only relevant in cases where there are multiple juveniles charged.

In addition to hearing the juvenile case itself, the court has other powers. The juvenile court has authority over certain school actions as well. For example, if your child has been expelled from school, the court can order that the state provide alternative education.

I have represented juveniles in Middlesex County at the trial and appellate level. Call now to speak with a Middlesex County Juvenile Lawyer. We can start right away defending your child’s case. The earlier we can get involved, the better.
